1. Introduction

BasedFroggies is a decentralised application operating on the Base network that allows users to breed, buy, sell, and collect unique digital Froggies. Access to BasedFroggies requires the use of compatible wallets such as MetaMask. By using BasedFroggies, you agree to these Terms of Use and our Privacy Policy.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the platform. By using BasedFroggies, you confirm you meet this requirement.

3. Wallets and Transactions

You are solely responsible for managing your crypto wallet and private keys. All transactions occur on the Base blockchain and cannot be reversed. We do not store private keys or manage user wallets.

4. NFT Ownership

Each BasedFroggie is a non-fungible token (NFT) representing a unique digital character. When you purchase a BasedFroggie, you own the NFT but not the intellectual property or artwork behind it.

5. License to Use Art

We grant you a non-exclusive, non-transferable licence to display theBasedFroggie artwork associated with NFTs you own, for personal use or resale on verified marketplaces. Commercial use is permitted only with our written permission.

6. Prohibited Conduct

• Engaging in unlawful, harassing, or fraudulent activity
• Distributing malware or attempting to exploit the platform
• Using the platform for money laundering or illegal financial activities
• Copying, reselling, or profiting from BasedFroggies IP without authorisation

7. Gas Fees and Marketplace Fees

All transactions require payment of gas fees to the Base network. Additional marketplace or breeding fees may apply and will be clearly communicated before confirmation.

8. Assumption of Risk

NFTs are speculative and volatile assets. You accept all risks associated with blockchain technologies, including wallet loss, smart contract bugs, market fluctuations, and regulatory changes.

9. Termination

We reserve the right to suspend or terminate access if you breach these Terms or act maliciously. You may also delete your account and discontinue use at any time.

10. Disclaimer

BasedFroggies is provided "as is" with no warranties. We do not guarantee uninterrupted access or compatibility with all devices or wallets. We are not liable for lost profits or indirect damages.

11. Limitation of Liability

To the maximum extent permitted under Scots law, our total liability shall not exceed £100 or the amount you paid us in the past 12 months.

12. Governing Law

These Terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
